The applicants are proposing a mixed residential development of the parcels recently annexed into the City of Buffalo south of Lake Pulaski. The proposed project consists of approximately 220 acres and is proposed to include 564 residential units, including single-family and twin homes, townhomes, and apartments. The development includes a preliminary plat to accommodate new construction and a rezoning to Planned Unit Development (PUD) amongst other potential zoning designations. PUD approval would allow flexibility with Code requirements including but not limited to lot size, type and size of housing, and setback requirements.  

 The applicants are also seeking a variance to Section 50.116.(a).(4).c of the City Code pertaining to controlled access to public waters for non-riparian lots to allow for private boat docks on a lot that does not meet the minimum lot size requirement of 15,000 square feet.

ORDINANCE NO. 2025-06

AN ORDINANCE AMENDING TITLE VII: BUSINESS REGULATIONS BY ADDING A NEW CHAPTER REGULATING RENTAL PROPERTY

THE CITY COUNCIL OF THE CITY OF MONTROSE ORDAINS:

Section 1. The Montrose City Code is hereby amended to add Chapter 79, Rental Property, to title VII to read as follows:

CHAPTER 79: RENTAL PROPERTY

79.01. PURPOSE AND APPLICABILITY.

A) The purpose of this Chapter is to protect the public health, safety and the general welfare of the people of the city. These general objectives include, among others, the following:

1) To protect the character and stability of residential areas;

2) To correct and prevent housing conditions that adversely affect or are likely to adversely affect the life, safety, general welfare and health:

3) To provide for minimum standards for heating and sanitary equipment and for light and ventilation necessary to protect the health and safety of occupants of buildings;

4) To prevent the overcrowding of dwellings;

5) To provide minimum standards for the maintenance of existing residential buildings and to thus prevent substandard housing and blight;

6) To preserve the value ofland and buildings throughout the city.

B) With respect to disputes between tenants and landlords, and except as otherwise specifically provided by the terms of this ordinance, it is not the intention of the City Council to intrude upon the accepted contractual relationship between tenant and landlord. The City Council does not intend to intervene as an advocate of either party, nor to involve itself in rent disputes, nor to act as an arbitrator, nor to be receptive to complaints from tenant or landlord which are not specifically and clearly relevant to the provisions of this Chapter.

79.02. SCOPE.

A) This Chapter shall apply to all rental dwellings in whole or in part for residential purposes. This chapter does not apply to retail, commercial, or industrial rental activities; Minnesota Department of Health-licensed rest homes, convalescent care facilities, group homes, nursing homes and assisted living facilities; hotels, motels; and manufactured home parks where the  

owner of the manufactured home is the primary occupant of the structure.

79.03. DEFINITIONS.

A) The following definitions shall apply in the interpretation and enforcement of this Chapter unless the context clearly indicates or requires a different meaning.

B) Whenever the words “rental dwelling,” “rental dwelling unit,” “premises,” or “structure” are used in this Chapter, they shall be construed as though they were followed by the words “or any part thereof.”

1) ACCESSORY USE OR STRUCTURES. A non-residential use or structure subordinate to and serving the principal use or structure on the same lot and customarily incidental thereto.

2) BUILDING. Any structure having a roof which may provide shelter or enclosure for persons or personal property, and when said structure is divided by party walls without openings, each portion of such building so separated shall be deemed a separate building.

3) CITY. The city of Montrose, Minnesota.

4) COMPLIANCE OFFICIAL. The City Administrator and designated agents authorized to administer and enforce this Chapter.

5) FAMILY. An individual, or two or more people each related by blood, marriage, adoption, or foster children, living together as a single housekeeping unit; or a group of not more than four (4) people not so related, maintaining a common household and using common cooking and kitchen facilities.

6) MULTIPLE FAMILY DWELLING. A rental dwelling or portion thereof containing two or more rental dwelling units.

7) OCCUPANT. Any person (including owner or operator) living, sleeping, cooking and eating in a rental dwelling unit or living and sleeping in a rental dwelling unit.

8) OPERATOR. The owner or any person who has been delegated by the owner for the charge, care, control, or management of a rental dwelling agent who has charge, care, control, or management of a building, or part thereof, in which rental dwelling units or rooming units are let.

9) OWNER. Any person, firm, or corporation who, alone, jointly, or severally with others, is in actual. possession of, or has charge, care or control of, any rental dwelling, rental dwelling unit, or rooming unit within the city as owner, employee or agent of the owner, or trustee or guardian of the estate or person of the title holder. Any person representing the actual owner shall be bound to comply with the provisions of this Chapter to the same extent as the owner.

10) PERMISSIBLE OCCUPANCY. The maximum number of people permitted to reside in a rental dwelling unit.

11) PERSON. An individual, firm, partnership, association, corporation, company or joint venture or organization of any kind.

12) PREMISES. A platted lot or part thereof or unplatted parcel ofland, and adjacent right-of-way either occupied or unoccupied by any dwelling or non-dwelling structure, including such building or accessory structures.

13) RENTAL DWELLING. A building or premises, or portion thereof, used or intended to be used for residential rental purposes.

14) RENTAL DWELLING UNIT. A single unit within a residential rental dwelling that provides complete independent living facilities for one or more people including permanent provisions for living, sleeping, eating, cooking and sanitation.

15) RENTAL PROPERTY. All premises, rental dwelling and rental dwelling units being used for residential rental purposes in the City.

16) SUBSTANDARD DWELLING. Any rental dwelling which does not conform to the minimum standards established by the City Code.

17) TENANT. A person who does not own, but occupies a dwelling for residential purposes, for payment of a fee or other compensation to the owner, under a lease or contract, written or verbal.

79.04. ENFORCEMENT AND INSPECTION AUTHORITY.

A) The Compliance Official shall administer and enforce the provisions of this Chapter. The Compliance Official shall conduct inspections during reasonable hours and present results to the owner or occupant in charge of the rental property.

79.05. LICENSE REQUIRED; FEE AND APPLICATION.

A) License.

1) Except as herein otherwise provided, it is unlawful for any person to lease any premises, dwelling or dwelling unit for residential rental purposes without first obtaining a license from the City.

2) All licenses are issued for a period of one (1) year from the date of issuance.

3) A license may not be transferred to another location nor another person without the prior approval of the City Council, or their designee.

4) A license renewal will be handled in the same manner as the original application.

B) Fee.

1) The annual license for rental property shall be established by the City Council.

C) Application.

1) Application for a license for rental property must be made on a form provided by the City and accompanied by the required license fee. The fee will be returned to the applicant if the application is rejected. The application must include all information requested on the form or as deemed necessary by the City including proof of a successful inspection made by the City.

2) If the applicant is a natural person, the application must be signed and sworn to by the person; if a corporation, by an officer authorized to sign; if a partnership, by all general partners.

3) It is unlawful to knowingly make a false statement in the license application. In addition to other penalties, the license may be subsequently revoked by the City Council for a violation of this Chapter.

D) Action on License.

1) The City Council, or their designee, may approve or deny the license upon completion of review of the application. If the City Council denies the license, it will notify the applicant of the denial and appeal rights provided in this Chapter.

79.06. CITY INSPECTIONS.

A) All rental dwellings and rental dwelling units are subject to inspection by the City to determine compliance with the applicable requirements as set forth in this Chapter. The Compliance Official may create a city policy which addresses the scope of inspections at rental properties. The owner or property manager must permit access and entry to the City for the following inspections:

1) An initial inspection upon application for a license. The City will not issue a license until each rental dwelling on the premises for which a license is sought complies with the applicable codes in this Chapter. The City may issue a license if, in the sole discretion of the Building Official’s judgment, the rental property complies with applicable codes, or the owner or licensee is diligently remedying violation.

2) Any re-inspections required due to a violation or noncompliance.

3) Inspections scheduled in response to complaints made to the City.

4) Inspections pursuant to City policy. The City Administrator may adopt an inspection policy and schedule considering each property’s inspection history, history of compliance with federal, state, and local laws, and the history of property maintenance violations, complaints, and other code enforcement violations at the property.

79.07. APPLICABLE CODES.

A) The City of Montrose building regulations and the state building code, which adopts by reference the international building and residential codes and the international fire code in their entirety, except as modified or amended in City Code, are adopted by reference in City Code Section 90.01 and incorporated into this Chapter applying to all rental dwellings, rental dwelling units and premises.

B) The City of Montrose has adopted by reference state hazardous building laws in City Code Section 90.02, which is incorporated into this Chapter.

79.08. MAINTENANCE OF RENTAL PROPERTY.

A) The owner and operator of rental property must maintain all rental property, including all rental dwelling units and common areas, in compliance with the applicable codes identified in Section 79.07 of this Chapter.

B) It shall be unlawful for any rental dwelling, rental dwelling unit or premises or portion thereof to be used for residential purposes or human habitation which is damaged, decayed, dilapidated, moldy, unsanitary, unsafe, vermin or rodent infested or which lacks provision for basic illumination, ventilation or sanitation facilities, or has been used to manufacture illegal substances, to the extent that the defects create a hazard to the health, safety or welfare of the occupants or of the public may be declared unfit for human habitation. If any of these hazardous conditions exist, the rental property shall be deemed to be a public nuisance, and the Compliance Official shall order the same to be vacated under City Code Section 10.22, as it may be amended from time to time.

C) It shall be unlawful for any rental property with hazardous conditions to be used for residential purposes or human habitation until all conditions have been corrected and written approval has been issued by the Compliance Official.

D) Any building or accessory use or structure that is deemed hazardous will be subject to City Code Section 90.02, as it may be amended from time to time.

79.09. MAXIMUM DENSITY, MINIMUM SPACE FOR RENTAL DWELLING UNITS.

A) No person shall permit or let to be occupied any dwelling or dwelling unit for residential rental purposes which do not comply with the following requirements:

1) Permissible Occupancy of Dwelling Unit: The maximum permissible occupancy of any rental dwelling units shall be determined as follows:

a) For the first occupant, 150 square feet of habitable room floor space and for every additional occupant thereof, at least 100 square feet of habitable room floor space.

b) In no event shall the total number of occupants exceed two times the number of habitable rooms in the dwelling unit.

2) One Family Per Dwelling Unit. Not more than one family, except for temporary guests, shall occupy a dwelling unit.

79.10. LICENSE DENIAL, SUSPENSION OR REVOCATION.

A) Denial, suspension, and revocation of licenses are governed by this Section.

B) Denial. The City may deny or refuse renewal of a license for the following reasons:

1) Applicant has had previous rental license revocations.

2) Applicant failed to provide required information on the City’s application form or provided false or misleading information.

3) Applicant has outstanding fines, penalties, or property taxes owed to the City.

4) The rental property or any rental dwelling or rental dwelling unit failed the initial property inspection in the opinion of the Building Official.

C) Suspension or Revocation: The City may suspend or revoke a license for the following reasons:

1) Violation of the applicable codes described in Section 79.07 of this Chapter.

2) Any violation or failure to maintain the rental property, or any rental dwelling unit in compliance with this Chapter and any applicable codes.

3) Leasing any rental property or rental dwelling or rental dwelling unit without a license.

4) Failure of the owner or manager to take action to evict or otherwise prevent a recurrence when a felony is committed on the licensed property by the tenant(s) or person affiliated with the tenant(s).

5) The applicant has outstanding fines, penalties, or property taxes owed to the city.

79.11. APPEALS.

A) The following appeals process applies when a license has been denied, suspended or revoked.

1) Hearing: Following receipt of notice of a license denial, suspension or revocation, an owner or operator may request a hearing before the City Council. An owner or operator must request a hearing in writing and file the request with the City Clerk within ten (10) days of the date of the notice of the license denial, suspension or revocation. Following receipt of a written request for a hearing, the City will schedule a hearing before a committee consisting of the Compliance Official or their designees.

2) Findings: After the committee conducts the hearing, it will report its findings and make a recommendation to the City Council. If the committee finds the license denial, suspension or revocation is proper, the Council may affirm the license denial, suspension or revocation. The City Council may also conclude the license denial, suspension or revocation is not warranted and change the license status.

3) Default: If the owner or operator does not request a hearing within the ten (10) day period or does not appear at the hearing, then the license denial, suspension or revocation will take immediate effect by default. In that case, the Compliance Official need not mail another notice of the license, denial or revocation to the owner or operator.

79.12. PENALTY.

A) Any person violating any provision of this Chapter shall be guilty of a misdemeanor.

Section 2. This Ordinance shall be effective immediately upon its passage and publication.
