WHEREAS, default has been made in the terms and conditions of the Declaration of Marsh Run Townhomes, C.I.C. No. 53 (henceforth the Declaration) dated June 22, 2002 and recorded in the office of the County Recorder in and for Wright County, Minnesota on December 19, 2002 as Document No. 822761, which Lien covers the following described property situated in the County of Wright and State of Minnesota, to-wit:

Lot 3, Block 1, Marsh Run, CIC No. 53, according to the plat thereof on file or of record in the Office of the County Recorder, in and for Wright County, Minnesota.

WHEREAS, pursuant to said Declaration, there is claimed to be due and owing as of the date of this Notice by Jeremiah Debolt and Jacqueline Debolt as unit owners to Marsh Run Townhomes Association, the principal amount of Three Thousand Two Hundred Eighty-one Dollars and 20/100 ($3,281.20) for assessments through April, 2019; and no action being now pending at law or otherwise to recover said debt or any part thereof, and;

WHEREAS, pursuant to said Declaration, and the statute in such case made and provided, said debt creates a lien upon said premises in favor of Marsh Run Townhomes Association.

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale created by statute, said lien will be foreclosed by the sale of said premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Wright County, Minnesota at the Sheriff’s main office, 3800 Braddock Avenue NE, Buffalo, MN, in said County on June 6, 2019 at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorney’s fees as allowed by law.  The time allowed by law for redemption by the unit owners, their personal representatives or assigns, is six (6) months from the date of said sale.

TIME AND DATE TO VACATE PROPERTY: If the real estate is an owner-occupied single family dwelling, unless otherwise provided by law, the date on or before which the unit owners must vacate the property if the lien is not reinstated under section 580.30 or the property is not redeemed under section 580.23 is 11:59 p.m. on December 6, 2019. If the foregoing date is a Saturday, Sunday or legal holiday, then the date to vacate the property is the next business day at 11:59 p.m.

AMENDMENT TO CITY CODE SECTION 2.14

DEPUTY CITY CLERK-TREASURER AND ASSISTANT ADMINISTRATOR

The City Council for the City of Buffalo, HEREBY ORDAINS that section 2.14 of the Buffalo City Code is hereby amended as follows:

“SEC. 2.14. CITY CLERK AND ASSISTANT ADMINISTRATOR-TREASURER.

Subd. 1. Separate Positions Created. The position of City Clerk and the position of Assistant Administrator-Treasurer are hereby created as distinct positions

Subd. 2. Delegation of Duties. All of the duties of the City Clerk are hereby delegated to the City Clerk and the duties of the Treasurer shall be delegated to the Assistant Administrator during such times or times as the City Administrator is absent from the City or disabled.

Subd. 3. Bond. The City Clerk and Assistant Administrator-Treasurer shall each furnish a fidelity bond conditioned on the faithful exercise of his or her duties. In lieu of such individual bond, the Council may provide for a blanket bond, furnished by a surety company authorized to transact business in the State of Minnesota, and covering the position and duties of the City Clerk and Assistant Administrator-Treasurer. Premiums on either of such bonds shall be paid from City funds.”

This amendment shall become effective upon adoption and publication.

AMENDMENT TO CITY CODE SECTION 6.43

FOOD TRUCKS AND MOBILE FOOD VENDORS AND FEE SCHEDULE

The City Council for the City of Buffalo, HEREBY ORDAINS as follows:

1. That Section 6.43 of the Buffalo City Code is hereby amended. This publication is a summary of the code and each section. A complete copy of the amended code may be found on the City’s website at ci.buffalo.mn.us or may be viewed during regular office hours at 212 Central Avenue, Buffalo.

“SEC. 6.43. MOBILE FOOD UNIT

Subd. 1. Purpose. The City of Buffalo will issue a permit to certain Mobile Food Units selling food from a vehicle mounted unit, either motorized or trailered. Applicants for a Mobile Food Unit Permit shall be otherwise exempt from the requirements of Section 6.36 of the Buffalo City Code regulating Peddlers, Solicitors, and Transient Merchants. The purpose of the regulations in this section is to protect the public health, manage potential conflicting uses of the public property and right of way, and minimize unfair competition with Fixed-Site Food Vendors in the community. Anyone selling food for public consumption in any way that is not in conformity with all of the provisions of this Section shall not be considered a permitted Mobile Food Unit.
