“SEC. 2.32. FIRE DEPARTMENT. A Volunteer Fire Department under the control of the Council is hereby established. The size, composition and remuneration shall all be established by resolution of the Council, which may be changed from time-to-time by subsequent resolution. The Council shall also establish written rules and regulations of the Department, a copy of which shall be distributed to each of its members. The Fire Chief and Assistant Fire Chiefs shall be appointed by the City Council for a term of two calendar years. The Captains shall be appointed by the City Council for a term of three calendar years. The terms of the Fire Chief, Assistant Fire Chiefs and Captains shall be staggered so that not more than one term shall expire in any given year. To achieve staggered terms, the initial appointment for Fire Chief or Assistant Fire Chiefs may be for a term of one year.  The Fire Chief shall appoint such officers as the Chief deems advisable, subject to confirmation by the City Council. The Fire Chief, Assistant Fire Chiefs, and Captains shall serve until their successor is appointed, unless otherwise removed for cause by the City Council after a public hearing. The Chief of the Fire Department shall have general superintendence of the Fire Department and the custody of all property used and maintained for the purposes of said Department. He or she shall see that the same are kept in proper order and that all rules and regulations and all provisions of the laws of the State and ordinances of the City relative to a Fire Department and to the prevention and extinguishment of fires are duly observed. He or she shall superintend the preservation of all property endangered by fire and shall have control and direction of all persons engaged in preserving such property. In case of the absence or disability of the Chief for any cause, one of the Assistant Chiefs shall be appointed by the City Council and shall exercise all the powers, perform all the duties and be subject to all the responsibilities of the Chief. The Chief of the Fire Department shall submit a periodic report to the Council covering the work of the Department for intervals required by the Council.”
This amendment shall become effective upon adoption and publication.
