Ordinance Summary

On April 18, 2018 respectively the City of Montrose City Council approved Ordinance 2018-07 An Ordinance Amending Chapter 55 (Nuisances) of The Montrose City Code.
The following is a summary of the Ordinance.  The Ordinance in its entirety is available for review and /or photocopying during regular office hours at the City of Montrose Offices, 311 Buffalo Avenue S., Montrose MN  55363
The summary shall read:
4) Permits real or personal property under his or her control to be used to maintain a public nuisance or rents the same, knowing it will be so used.
5) Permits, maintains, or harbors an accumulation of junk, garbage, rubbish, disused furniture, appliances, machinery, inoperable or unserviceable motor vehicles, vehicles not displaying current registration, automobiles and parts thereof or any matter which may become a harborage for rats, snakes or vermin, which creates a visual blight, or which may be conducive to fire, or which endangers the comfort, repose, health, safety or welfare of the public.
55.011.       DEFINITIONS.
(A) The following words, when used in this ordinance, shall have the meanings ascribed to them:
1) Garbage includes all decayable animal, vegetable or other matter that attends the preparation, consumption, display, dealing in or storage of meat, fish, fowl, birds, fruit, or vegetables, including the cans, containers or wrappers wasted along with such materials.
2) Rubbish is non-decayable solid wastes such as dimensional lumber, wood, leaves, trimming from shrubs, dead trees or branches thereof, shaving, sawdust, excelsior, wooded waste, printed matter, paper, paper board, paste boards, grass, rags, straw, boots, shoes, hats and all other combustibles not included under the term garbage, and any item where placement outside is not appropriate for the season (e.g. swimming pools in the winter)
55.05. DUTIES OF CITY OFFICERS.
The Zoning Administrator shall be primarily responsible for enforcement of nuisances, pursuant to the authority vested in the City Administrator or designee in Section 25.02 of the City Code.
